Statutory 10% Basic Holdback (Ontario Construction Act, Section 22)

Every payer upon a contract or subcontract shall retain a 10% holdback from each progress payment. By law, this holdback cannot be released until 60 calendar days following the publication of the Certificate of Substantial Performance (CSP / Form 9) in a construction trade newspaper, provided no claims for lien have been registered or preserved against the property title (Section 31).
